Article 1: General Terms

  • Services Provided: Performance Coaching, HRV Coaching, or Coaching and Nature, available as 1:1 sessions as part of coaching packages (1 month – 3 months – 6 months). Coaching sessions take place on a weekly (45 min) or bi-weekly basis (90 min), in-person or online, in German or English.
  • Payment Terms: Payment is required in advance for all services. PayPal and bank transfers are accepted as payment methods. The full price for the package of coaching sessions will be payable before the first session. Bank fees are to be covered by the client ensuring that the full amount of euro is received by the coach.
  • Cancellation Policy: Cancellations must be made at least 3 days before the session to be entitled to re-scheduling within package period. 24 hours before the session and / or non-attendance: no re-scheduling within package period.

 

Article 2: Responsibilities

  • Both parties to the contract commit to highly motivated dedication for the success of the coaching and to absolute discretion and confidentiality.
  • Both parties explicitly acknowledge their respective personal responsibility. The coaching process does not guarantee specific results.

 

Article 3: Confidentiality

  • All client information is kept confidential and is not shared with third parties without explicit consent.

 

Article 4: Release of Information:

  • The coach engages in training and continuing education pursuing and/or maintaining ICF (International Coach Federation) Credentials or those relating to EMCC (European Mentoring and Coaching Council). That process requires the names and contact information of all clients for possible verification by the ICF or EMCC.
  • By having coaching sessions, you agree to have only your name, contact information, and start and end dates of coaching shared with ICF/EMCC staff members and/or other parties involved in this process for the sole and necessary purpose of verifying the coaching relationship, no personal notes will be shared.
  • The coach reserves the right to seek (anonymized) collegial advice within the framework of their own professional development (supervision).

 

Article 5: Liability

  • Limitations of Liability: Coaching services are designed to support personal and professional development. However, the coach does not guarantee specific outcomes and is not liable for any decisions made by clients based on coaching sessions.
  • The coach is only liable for intent and gross negligence, limited to the offer price. Amendments and side agreements must be in writing.
  • Disclaimers: Coaching services are not a substitute for medical advice, diagnosis, or therapy. Medical or psychological treatment are not offered in coaching sessions. Clients should seek professional medical advice for any health-related issues. Coaching focuses on personal and professional development, not medical treatment.

 

Article 6: Intellectual Property

  • Ownership of Materials and Content: All materials and content provided during coaching sessions are the intellectual property of the coach.
  • Use of Materials: Clients are granted a non-exclusive license to use the materials for personal development purposes only.

 

Article 7: Termination

  • Termination Conditions: The contract becomes effective upon signature by both parties. The client owes 100% of the total agreed package amount if they do not utilize the agreed services of the contractor, even without a formal cancellation. The contract can only be terminated in writing by either party for good cause, regardless of the possibility of mutual termination.
  • Consequences of Termination: Upon termination by the client, any unused parts of the coaching package will not be refunded.
  • Termination after First Coaching Session: Within 24 hours after the first coaching session, the client can decide to terminate the coaching package immediately by sending an email and will get a full refund of the package price within 3 days.

 

Article 8: Force Majeure

  • In the event of force majeure, the coach is entitled to suspend or terminate the contract in whole or in part after written notification to the client without judicial intervention, without the coach being obliged to pay any compensation.
  • Force majeure includes all circumstances beyond the coach’s control that make the fulfillment of the contract impossible or unreasonable, such as strikes, riots, natural disasters, operational disruptions, or governmental actions.

 

Article 9: Severability Clause

  • Should any provision of this contract be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
  • The invalid provision shall be replaced by a provision that comes closest to the economic purpose of the invalid provision.

 

Article 10: Applicable Law

  • These Terms and Conditions are governed and construed in accordance with the laws of the Federal Republic of Germany.
